1. Agreement & Acceptance 

  • These Terms govern your access to and use of CaPOS’s services (“Platform”, “Software”, “Services”). By registering or using the Services, you accept these Terms and the Privacy Policy. 
  • You warrant that you are at least 18 years old and legally able to enter into contracts in Ontario, Canada. 

2. License, Use & Restrictions

  • CaPOS grants you a limited, nonexclusive, nontransferable license to use the Software for your business operations. 
  • Unauthorized copying, reverse engineering, reselling, sublicensing, or exploitation of the Software is strictly prohibited. 
  • We reserve the right to modify, suspend, or discontinue features with prior notice.

3. Trials, Orders & Fees

  • We may offer demo or trial access for evaluation. Upgrades or full subscriptions incur fees. 
  • Subscription fees are clearly disclosed. Delayed payments may result in suspension or termination of Service. 

4. User Obligations & Security


  • You are responsible for safeguarding your login credentials and preventing unauthorized access. 
  • Misuse of Services (fraud, abuse, violating laws) may result in immediate termination without refund.

5. Confidentiality & Intellectual Property

  • All software, trademarks, documentation, and content remain CaPOS’s property. 
  • You agree to maintain confidentiality of proprietary information  

6. Data Handling & Privacy Law Compliance

  • You agree to collect, use, process, or disclose personal information only in accordance with privacy laws (PIPEDA and applicable provincial laws) and obtain necessary consents 

7. Limitation of Liability

  • CaPOS is not liable for indirect, incidental, consequential, or special damages, including data loss or business interruption, except as required by law. 

8. Dispute Resolution & Governing Law

  • These Terms shall be governed by Ontario law. Any dispute will be resolved in courts located in Ontario. 
  • Parties should attempt informal resolution before formal legal action.

9. Modification of Terms & Termination


  • CaPOS may amend these Terms with reasonable notice. Continued use after changes constitutes acceptance. 
  • Either party may terminate for material breach; subscription fees are nonrefundable unless otherwise stated.

Privacy Policy 

1. Scope & Regulatory Framework

  • This Privacy Policy applies to personal data collected via CaPOS’s website, Software, and Services in Canada. 
  • We are committed to compliance with PIPEDA and provincial privacy laws (e.g., Ontario), including breach notification and access rights  

2. Information Collected

  • Personal Information: name, email, address, business details, payment information, IP address, device/browser info—collected when you register or use the Services. 
  • Usage Data: transaction logs, activity timestamps, technical details for system security, performance analysis. 

3. How We Use Your Data

  • To deliver and maintain Services, manage accounts, process payments, provide support, send updates, and improve our offerings. 
  • With explicit consent, we may also send marketing messages; unsubscribing is permitted at any time. 

4. Data Disclosure & Third Parties

  • We do not sell personal data. We may disclose information: 
  • to third-party service providers (e.g., payment processors, email providers), 
  • as required by law or regulatory authorities, 
  • in connection with corporate changes (sale or merger). 
  • When disclosing personal data outside Canada, we ensure protections equivalent to Canadian privacy standards (aligned with PIPEDA cross-border guidelines). 

5. Retention & Deletion

  • Data is retained only as long as needed for service provision or legal obligations. 
  • Upon account termination, personal data is deleted or anonymized within a reasonable timeframe (e.g. 30–90 days), subject to legal needs. 

6. Security Measures

  • We apply industry-standard protections: encrypted transmission (SSL/TLS), firewalls, access controls. 

7. Cookies & Tracking

  • We use cookies for site functionality, session management, analytics, and preferences. 
  • Users can disable cookies via browser settings; disabling may affect site performance. 

8. Your Privacy Rights

  • In accordance with PIPEDA, you have the right to:

  • request data portability. 

9. Children’s Privacy

  • Our Services are not targeted at children under 13. If we become aware of collection of such information, we delete it promptly.
